Happy Friday! Here is what The Park at Club West team has been working on this week. We intend to update you each week and always welcome your input, ideas, and suggestions to improve and enhance our efforts.

*Setting The Record Straight This Week

Claim: The Club West Conservancy claims the FCW HOA Board of Directors held “secret meetings” with home builders to draft an Amendment to “grease the skids” for new homes.

Truth: The HOA alone obtained the Declarant Rights, wrote the Amendment and shepherded the process by which it was enacted and publicized to the community. They did this specifically to:

  1. Prevent developers from obtaining the Declarant Rights and doing anything without Homeowner approval.
  2. Strengthen land use restrictions on the property.
  3. Eliminate the expiration date which would have left the property unrestricted in a few years.
  4. Give the power to the Homeowners, not the BOD, not developers.

Even the CWC understands this. A local attorney, who supports the CWC, has publicly said that the Amendment the CWC lawsuit challenges was “good news”.

“This amendment is good news in [that] the prior declaration had an expiration clause, and this one does not. The prior declaration had no restriction on the “Declarant” rights to amend / void the land use restriction. This one does.”

-CWC supporter and attorney who, while accusing the BOD of improperly obtaining Declarant Rights, somehow also supported the terms of the Amendment the CWC is challenging.

The CWC clearly wants to assure nothing can happen. Do not let them use subterfuge to assure we all suffer.
